The privacy and security of your personal information is very important to us. Resourceful Thinking is the controller of your personal data for the purposes of the Swiss Federal Act on Data Protection (“FADP”) and, to the extent your personal data is also subject to those regimes because you are located in, or we monitor the behaviour of, the European Union or United Kingdom, the EU General Data Protection Regulation (“GDPR”) and the UK GDPR.

As part of our commitment to protecting your personal data in a transparent manner, this Privacy Statement explains:

  • why and how Resourceful Thinking collects, uses, and stores your personal data;

  • the basis on which your personal data is processed;

  • who we share your personal data with, and where it may be transferred; and

  • what your rights are, and how you can exercise them.

This Privacy Policy should be read together with our Cookie Policy, available at www.resourcefulthinking.ch/cookiepolicy, which provides further detail on the specific cookies and similar technologies used on our website, and our Terms of Use / Disclaimer, available at www.resourcefulthinking.ch/terms_of_service

1. Scope of This Privacy Statement

This Privacy Policy applies to personal data we collect through our website at www.resourcefulthinking.ch (the “Site”), including via our contact form, newsletter sign-up, and careers page, as well as personal data we collect in the course of any subsequent engagement with you as a client or business contact.

In this Privacy Policy, we refer to information about you as “personal data” or “personal information”, and to our collection, storage, use, and protection of that information collectively as “processing”.

2. What Information We Collect

We collect personal data about you in a number of ways:

  • Directly from you — for example, when you complete our Contact Us form, subscribe to our newsletter, submit a job application via our careers page, or otherwise correspond with us.

  • Automatically, through your use of the Site — for example, via cookies and similar technologies used for analytics and social media integration (see Section 5, Cookies and Analytics).

  • From third parties — for example, from your employer, from publicly available sources, or from social media platforms (such as LinkedIn) where you interact with our content.

The personal data we collect may include, depending on your interaction with us:

  • Contact details: name, email address, phone number, postal address, company/organisation, and job title;

  • Enquiry and communication content: the content of messages you send us and details of our correspondence with you;

  • Newsletter data: your email address and engagement data (e.g., opens and clicks) if you subscribe to our newsletter;

  • Careers/recruitment data: your CV/résumé, cover letter, employment history, education, references, and any other information you choose to submit as part of a job application;

  • Technical data: your IP address, browser type and version, device information, operating system, referral source, pages visited, and time spent on the Site, collected via cookies and analytics tools; and

  • Social media data: information made available to us when you interact with our LinkedIn page or other social media presence, or when you engage with content that uses the LinkedIn Insight Tag or similar tools.

None of the information we request from you is mandatory to browse the Site generally. However, certain information is necessary for us to respond to your enquiry, process a job application, or send you our newsletter.

Our Site is not directed at, and is not intended for use by, children. It is not our policy to knowingly collect personal data from children.

3. How We Use Your Information

We use your personal data for the following purposes, among others:

  • to respond to enquiries submitted through our Contact Us form;

  • to send you our newsletter and other communications you have opted in to receive, and to manage your subscription preferences;

  • to assess job applications submitted via our careers page;

  • to operate, maintain, and improve the Site, including through analytics;

  • to manage our social media presence and measure the effectiveness of our content and outreach (including via the LinkedIn Insight Tag);

  • to comply with applicable legal and regulatory requirements, and to respond to requests from competent authorities;

  • for administrative purposes, record-keeping, and to protect our legal rights and those of our affiliates; and

  • to prevent, detect, and investigate fraud or other unlawful activity.

4. Basis for Processing

As a Swiss company, our processing of your personal data is principally governed by the Swiss FADP, which requires that processing be lawful, carried out in good faith, and proportionate to its purpose, and that you are informed of that purpose. Where the GDPR or UK GDPR also applies to your personal data (for example, because you are located in the EU or UK), we additionally rely on the following legal bases, as applicable:

  • Consent for example, where you subscribe to our newsletter, or where non-essential cookies (such as analytics or the LinkedIn Insight Tag) are set on the Site, which we will only do with your consent obtained via our cookie banner, and which you may withdraw at any time;

  • Legitimate interests where processing is necessary for our legitimate interests in operating and promoting our business, responding to enquiries, maintaining the security and functioning of the Site, and assessing job applications, provided those interests are not overridden by your interests or fundamental rights;

  • Legal obligation  where processing is necessary to comply with a legal or regulatory obligation to which we are subject; and

  • Contract or pre-contractual steps  where processing is necessary to take steps at your request prior to entering into an engagement with you, or to perform an agreement with you (for example, in connection with a job offer).

Where we process any special category (sensitive) personal data, we will only do so where permitted by applicable law, for example, where necessary for the establishment, exercise, or defence of legal claims, or where you have explicitly consented.

5. Cookies and Analytics

We use cookies and similar technologies on the Site, including:

  • Google Analytics, to help us understand how visitors use the Site and to improve its content and performance;

  • the LinkedIn Insight Tag, to help us understand engagement with our content and measure the effectiveness of our outreach on LinkedIn; and

  • cookies set by our website platform, Squarespace, to operate and secure the Site.

These tools may collect technical data such as your IP address, device and browser information, and browsing behaviour on the Site, and may result in your data being processed by Google LLC, LinkedIn Corporation, and Squarespace, Inc. (each based in the United States) as further described in Section 6 (International Data Transfers).

Full details of the specific cookies used, their purpose, duration, and how you can manage or withdraw your consent to non-essential cookies, are set out in our Cookie Policy, available at www.resourcefulthinking.ch/cookiepolicy. Non-essential cookies, including analytics and social media cookies, are only set with your consent.

6. International Data Transfers

Our Site is built on the Squarespace platform and hosted on infrastructure operated by Squarespace, Inc. in the United States, with our domain name registered through GoDaddy.com. Given the nature of our business and our use of third-party service providers, your personal data may be accessed, processed, or stored outside Switzerland, the European Economic Area (“EEA”), and the United Kingdom, including by:

  • Squarespace, Inc. (website hosting and platform services);

  • Google LLC (Google Analytics);

  • LinkedIn Corporation (LinkedIn Insight Tag); and

  • our newsletter provider, Mailchimp (The Rocket Science Group LLC) and/or Substack Inc., as applicable,

each of which is based in, or processes data in, the United States.

Where we transfer personal data outside Switzerland, the EEA, or the UK to a country that has not been recognised as providing an adequate level of data protection, we take steps to ensure appropriate safeguards are in place, which may include:

  • relying on the recipient's certification under the Swiss-U.S. Data Privacy Framework and/or the EU-U.S. Data Privacy Framework, where applicable;

  • entering into standard contractual clauses approved by the European Commission and recognised under Swiss law (including, where applicable, the UK International Data Transfer Addendum or Swiss-specific amendments) with the recipient; and

  • relying on a recognised derogation under applicable law, where relevant and permitted (for example, your explicit consent for a specific transfer).

Further details of the safeguards we use in relation to a specific transfer are available on request by contacting privacy@resourcefulthinking.ch.

7. Who We Share Your Information With

We may disclose your personal data to:

  • third-party service providers who support our business, including our website platform (Squarespace), domain registrar (GoDaddy.com), analytics provider (Google), social media platform (LinkedIn), and email/newsletter provider (Mailchimp and/or Substack);

  • professional advisers, including lawyers, accountants, auditors, and consultants;

  • competent authorities, including courts, tribunals, tax authorities, and regulators, where required by law or to respond to a lawful request; and

  • a prospective buyer or successor in connection with any reorganisation, merger, sale, or transfer of all or part of our business or assets.

We do not sell your personal data to third parties.

8. How Long We Keep Your Information

We retain your personal data for as long as reasonably necessary for the purpose for which it was collected, taking into account:

  • the length of time needed to fulfil the relevant purpose (for example, responding to your enquiry, or the duration of any recruitment process);

  • any retention period required by applicable Swiss, EU, or UK law or regulation; and

  • the period during which a legal claim could be brought in connection with our relationship or your use of the Site.

Newsletter data is retained for as long as you remain subscribed, and for a limited period thereafter for record-keeping purposes. Job application data is retained for the duration of the relevant recruitment process and for a limited period afterwards, unless you consent to us retaining it for future opportunities.

9. Your Rights

Subject to applicable law, you have the following rights in relation to your personal data:

  • Access: to request a copy of the personal data we hold about you;

  • Rectification: to ask us to correct or update inaccurate or incomplete personal data;

  • Erasure: to ask us to delete your personal data, in certain circumstances;

  • Restriction: to ask us to restrict the processing of your personal data, in certain circumstances;

  • Objection: to object to our processing of your personal data, including processing based on legitimate interests, or for direct marketing purposes at any time;

  • Portability: to receive certain personal data you have provided to us in a structured, commonly used, machine-readable format, and to have it transmitted to another controller, where technically feasible (where the GDPR or UK GDPR applies); and

  • Withdraw consent: where processing is based on your consent (such as newsletter sign-up or non-essential cookies), to withdraw that consent at any time, without affecting the lawfulness of processing before withdrawal.

To exercise any of these rights, or if you have any other questions about our use of your personal data, please contact us at privacy@resourcefulthinking.ch. We may need to verify your identity before responding to your request.

10. EU and UK Representative

As at the date of this Privacy Statement, Resourceful Thinking has not appointed a representative in the European Union or the United Kingdom under Article 27 of the GDPR or the equivalent provision of the UK GDPR. [EU/UK REPRESENTATIVE DETAILS – TO BE CONFIRMED, if and when appointed].
